Did you try getting it repaired anyway? I don't think Apple is as mean as other companies *cough*Micro$oft*cough*. They might have helped you anyway.

When I went to Apple they said the matter was out of their hands and asked if I had a warrenty with the store I purchased it in (Best Buy) which I didn't

When I went to get it fixed... The charge was 100 bucks...(I didn't get it fixed)
For some reason I didn't want an ipod anymore...

I am currently looking for a new mp3 player...
